Vietnam work permit is a document allowing foreigners to work legally in Vietnam. Foreign workers working for more than 3 months at enterprises and organizations in Vietnam are required to apply for a work permit and enter into an employment contract.
Subjects who are required to have a Vietnam work permit
Subjects being granted work permits are foreigners who come to work in Vietnam under the following forms:
+ Performance of employment contracts;
+ Internal mobility;
+ Performance of various types of contracts or agreements in terms of economics, commerce, finance, banking, insurance, science and technology, culture, sports, education, vocational training and health;
+ Service provider under the contract;
+ Service offers;
+ Working for foreign non-governmental organizations, international organizations in Vietnam which are authorized to operate in accordance with Vietnamese laws;
+ Being volunteers;
+ Being person who are responsible for establishing the commercial presence;
+ Being managers, executive directors, experts, technical workers;
+ Participating in the implementation of bidding packages and projects in Vietnam.

Conditions for being granted a Vietnam work permit
+ Having full civil act capacity in accordance with the laws.
+ Being physically fit with the job requirements.
+ Being managers, executive directors, experts or technical workers.
+ Foreign workers working as medical practitioners, directly providing medical examination and treatment in Vietnam or working in the field of education, training and vocational training must fully satisfy the requirements prescribed by Vietnamese laws on medical examination and treatment, education, training and vocational training.
+ Not being a criminal or prosecuted for criminal liability in accordance with the laws of Vietnam and foreign laws.
+ The employment of foreign workers is approved in writing by the competent authorities.
Term of a Vietnam work permit
The term of a Vietnam work permit does not exceed 2 years. However, depending on the agreement between the foreign workers and the employers, the term of the work permit in each specific case will vary.
In case the work permit expires and the worker is still working at the same company, it is necessary to carry out the procedures to apply for re-granting the Vietnam work permit.
Application for Vietnam work permit
+ Written approval of the job position taken by the foreign worker.
+ Criminal record certificate (Written document proving that the applicant does not commit any crime or is not prosecuted for criminal liability according to the provisions of Vietnamese laws).
+ Health certificate issued by foreign institute or Vietnamese institute as prescribed by the regulations of the Ministry of Health.
+ Document certifying the applicant is a manager, executive director, expert, technical worker, etc.
+ 2 4×6 photos, white background, taken within 6 months.
+ Notarized passport copy.
+ Application form for Vietnam work permit.
+ Other documents related to the foreign worker.
Notes: If some above-mentioned documents are issued by the foreign agencies, they must be legalized and translated in accordance with the provisions of Vietnamese laws.

Time to process application for Vietnam work permits
It is necessary to submit an explanation of the demand for employing foreign workers at least 30 days in advance. After completing the required set of documents, you may submit the application for new granting of work permit. After 7 working days (excluding Saturday, Sunday and public holidays), you can obtain a Vietnam work permit.

Place to apply for Vietnam work permit
+ If the enterprise is located in an industrial park, the application shall be submitted to the industrial park management board.
+ If the enterprise is not located in any industrial park, the application shall be submitted to the Department of Labor, War Invalids and Social Affairs of the province/city where the foreign worker is expected to work.
